The Important Role Played by Process Servers

Did you know that our civil courts couldn’t operate without process servers? These trained professionals serve to ensure that all individuals and companies retain their right to due process. Here’s what due process is, why it’s important, and how private process servers fill that role.

What is due process?

The U.S. Constitution gives us the right to “due process,” but what does that actually mean? Due process means that an individual must be given the opportunity to defend themselves in a court of their peers. And, thanks to Citizens United Vs. FEC, companies are granted the same rights as individuals in such circumstances.

Why is service of process important?

Without due process, people could sue anyone and get awarded damages regardless of evidence. More importantly, this same right to due process applies to criminal law, which protects your freedom. These rights are protected by service of process, or serving legal papers to all parties in a case so that they are notified of the case and their rights, as well as any hearing or court dates.

What about private process servers?

In the state of Florida, only a registered private process server or sheriff’s department can serve legal papers. Private process servers have a lot more time and resources to get the job done quickly, so your case can move forward. If you can’t prove that the other parties to the case were notified, your case could be dismissed.
