Three Common Challenges that Private Process Servers Face

When you need a private process server, you may not be giving much thought to the process of serving legal documents. There are a lot of challenges that private process servers face in the course of duty. Understanding what they go through on a daily basis can help you appreciate the service that they are providing. Here are just a few of the challenges private process servers face.

Skipping Town

It is not uncommon for someone who knows that a legal case is looming to skip town and try to avoid being served. Whether someone moves or just goes out of town on a sudden vacation, it can make it difficult to get them served. Private process servers have a lot of tools at their disposal to work around these challenges and find the people who need to be served.

Private Property

Because private process servers are not law enforcement, they cannot go onto private property to serve papers. Going up to someone’s front door is not a problem most of the time. However, if someone has no trespassing signs posted on their property, the private process server may not enter. This can be circumvented by serving the individual at another location, such as at work.

Violence

Sometimes people who need to be served are so upset and angered by the legal case that they take it out on the private process server. Many process servers are armed in some way to protect themselves. However, again, they are not law enforcement, so they can only practice self defense. However, in the state of Florida, threatening a private process server is a misdemeanor, and hurting a process server is a felony. They can always contact law enforcement for assistance.
